Some background for those of = you who have not been directly involved…

Per = instructions we received from John Melk when Keitu got the industrial = storm water permit (for a discharge to Sixmile Creek) for AIC Energy = Corp over a year ago, we have been filing this report on AIC’s = behalf since the permit was activated. We have been invoicing this = work either under the “Ad Hoc Technical Services” project, = but more recently under the KTO-2022-02 water permit task order. = But once the permit acknowledgement is signed and the permit activated, = our work associated with the permit application is over and we expect to = close out the task order and submit the final project = invoice.

We have a letter from John authorizing to act on = AIC’s behalf on the air permit. But I don’t have a = corresponding document from John on the NPDES wastewater discharge = permit.

We need something in writing, as there are legal = responsibilities for the permit holders.

As Jaimee = outlined in her note, once we open a connection to Sixmile Creek for the = clean stormwater from the existing storm water pond at the site in early = Summer (part of confirmed approved KTO-2022-06 Williams County CUP = compliance task order), all discharged water volume will need to be = measured, recorded and reported. Until the March 13 conversation I had = with Snow and Phil where apparently AIC is tapering off our involvement = in the project, we had expected to continue to provide those services = under the Ad Hoc Technical Services project. That’s is of course = AIC’s right. But be aware AIC’s responsibilities as = the permit holder.

So let us = know how you wish to proceed as soon as it is convenient so we can plan = our staffing levels accordingly.

The final NDPES Wastewater Discharge Permit was = sent, via email, yesterday to Keitu and the directory. =

Included in the email was an attachment that = needs to be signed and sent in to the DEQ to confirm the receipt of the = permit. Let us know if you need Keitu to send the permit receipt into = the Dept.

Also there are a few = notes.

The submittal for the Discharge Monitoring Reports = (DMRs) will now be effective for this = permit.

Monthly DMR due May 31, 2023.

Quarterly DMR due July 31, = 2023.

Semi-annual DMR due October 31, = 2023.

The initial DMRs will be a simple submittal through = the DEQ electronic reporting system. The initial DMRs will be = marked as no discharge reported.
Once wastewater discharges start to occur to the = Missouri river sampling will need to be completed. The parameters and = sample types are laid out in the permit.

Additionally we have been handling the = submission of the DMR submission for the Industrial Stormwater Discharge = Permit. This is a quarterly reporting.
