This email string is probably the best to give you a synopsis of = the issue. We are holding off on any easement work or contacting any = area landowners we hear back from AIC on how best to proceed and the ND DEQ=

I have not yet heard back from Roger or anyone else from AIC =E2=80= =93 but he was on vacation last week and is likely still catching up.<= /o:p>

I also have not heard back from the ND DEQ NPDES permitting program manage= r Martin Haroldson to make sure they will accept either or both of the late= st two area proposed for a discharge point (in =E2=80=9Cred=E2=80=9D or in = =E2=80=9Cwhite=E2=80=9D on the maps) =E2=80=93 lets call them option C and = option D respectively. I honestly thought, at worst, the ND DEQ would= have been okay with a wastewater discharge point in that back channel alon= g the McCullough/Mattison property if we pushed it =C2=BC mile (1350 feet) = further east than we originally proposed into the main backwater channel (s= ee proposal B). Which would have kept us on the same land parcel as w= e originally proposed, just a bit more expensive easement. We pulled = the river water levels and believed that that backwater area had not gone b= adly shallow i.e. under 8 feet on the Williston USGS river gauge since abou= t 1965. 0094.JPG was taken when the gauge was at 14.73 ft on November= 23, 2020. So I was surprised. This water flow is more than the= Heart River which the Marathon Dickinson refinery via the City of Dickinso= n discharges to.

The voice mail Mr. Haroldson left saying that even t= he further east location i.e. =E2=80=9CProposal B=E2=80=9D is still not acc= eptable is attached.

It may be worthwhile for me to chat with the pe= rmitting staff at the Bismarck office of the Corps of Engineers to find out= if we can qualify for an existing =E2=80=9Cgeneral=E2=80=9D permit f= or a discharge structure downstream of the Mortenson river water intake. We= have already opened a dialog with their staff regarding the stormwater dis= charge point in Sixmile Creek and they laid out in that instance what we al= ready had a =E2=80=9Cgeneral=E2=80=9D permit to do (typically referred to a= s a Nationwide Permit with easy 90 days necessary to qualify for coverage) = or if we had to get a project specific permit i.e. 9 to 24 months.

Let me start that it will take about 1 y= ear to get a NPDES wastewater discharge permit from the ND DEQ to be able t= o release the water to the river. That is separate permit than a disc= harge structure permit (pipe exit and rip rap or erosion control =E2=80=9Cw= ings=E2=80=9D) from the Corps. We had planned on a very simple struct= ure to extend a pipe out over the river and let the water fall into the riv= er. The original plan (see green line) had enough elevation on the ba= nk to do that. We would not have needed a permit from the Corps becau= se all the disturbance would have been on private land. If we disturb= less than 0.1 acres total (about the size of the endzone of a football fie= ld) including trenching, then the necessary permit is very easy to get =E2= =80=93 say 90 days after the application is submitted.

The westside = option (red) is at the Mortenson water intake area. This shoreline is= owned by the US Government / US Army Corps of Engineers which complicates = permitting / delays permitting but we should be able to get it within 2 yea= rs or less. Maybe a year if we keep the discharge structure small whi= ch we should be able to do. But we could use the same 5 mile easement= and just lay the river water line (blue) and a wastewater discharge line i= n the same trench. We would have to separate the actual discharge poi= nt about 100 feet from Mortenson=E2=80=99s intake because we don=E2=80=99t = want to suck back the water we just discharged.

The other opti= on is pretty much directly east (white). We found a 1 mile+ shoreline= area that the Corps do not own the shoreline =E2=80=93 it is privately hel= d. This simplifies permitting any discharge structure, maybe not requ= iring a Corps permit at all or certainly makes it possible to do what we ne= ed to do and disturb less than 0.1 acres of their jurisdiction. But w= e will need to work with multiple landowners to get the necessary pipe ease= ment and it may cost us more than what we are expecting to pay for the rive= r water line because the landowners for the river water line are looking fo= r hookups to their irrigation systems.

Call if you have questions.&nb= sp; I had thought the ND DEQ would have approved our original location, if = we had moved it 500-1500 ft further east to get it out in the smaller flowi= ng channel in that backwater, but they are concerned that future developmen= t in the industrial park would put too much load on that river channel and = that backwater gets pretty shallow on rare occasion =E2=80=93 see the 2003 = historical aerial photo on Google Earth. They should be very happy wi= th either of their two options. I will need to return to the Corps of= Engineers for another discussion with them once we get confirmation.<= /o:p>

I heard through the grapeline that Interstate Engineering got the civil si= te prep work. We had asked them to give us a non-committed quote for = the off site wastewater line. I want to say $35K for that adder work.= They might expect a little bit extra $$ to layout a 5 mile vs. 1.5 m= ile line =E2=80=93 but unlikely very much more than their original estimate= My guess would be less than $10K more. Don=E2=80=99t know.&nb= sp; Don=E2=80=99t need them to start on anything until we get some assuranc= es from the ND DEQ and US ACE and we work through the easement/route.<= /o:p>
