Not technically exempt =E2=80=93= but there is another mechanism we will use. Very few people can comm= it the federal government to do anything.

Under US federal law, = AIC Energy Corp has the right to declare portions of their permit applicati= on as =E2=80=9CBusiness Confidential=E2=80=9D which will prevent the federa= l government from turning over these records to an external public request = under the Freedom of Information Act (typically referred to as a FOIA reque= st). Any of these requests need to be judged legitimate by the federa= l permitting staff. So we can=E2=80=99t do the entire permit applicat= ion but you can do portions. We frequently declare portions regarding= propriety technology and financial records specific to the company if it i= s not publicly held. Things like contracts with organizations can also be d= eclared business confidential. Never had an issue with a federal agen= cy declaring those types of document. Sometimes client want the entir= e application or the marketing study or the financial projections. Th= at does not work. But once we declare information Business Confidenti= al (correctly) then federal employees are bound by federal law to keep it c= onfidential.

But it is incumbent upon us to use this mechanism a= s part of our responsibility under our NDA to protect the respective confid= ential information we are given access to. ( Eric and Amy will get a chance= to learn how to package the materials =E2=80=9Celectronically=E2=80=9D to = meet the requirements for declaring info =E2=80=9CBusiness Confidential=E2= =80=9D)

If you request refers to the yield data and other inform= ation relative to the two technology providers =E2=80=93 we need to be care= ful not to get too detailed with our financial projects. Would not wa= nt anyone to be able to infer yield from them. Otherwise we will need= to mark them confidential and give the reason why.

I assume tha= t the USDA third party engineering reviewer (Leidos) and any other entity t= hat AIC hired to assist with the review (like ICF) signed a NDA when AIC hi= red them because they technically are working for AIC.
